FORECLOSURE PRACTICE GROUP

The work of the firm's Foreclosure Practice Group begins when a foreclosure file is received from banks or mortgage servicers anywhere in the United States holding delinquent loans secured by real estate located anywhere in New York State.

  • New files are entered on the firm's computer system. A foreclosure search is ordered; the summons and complaint is prepared, filed and sent out for service. The litigation is underway! Each paralegal handles a file from commencement of the action to the conveyance of title to the successful bidder. He or she is responsible for prosecuting the foreclosure action diligently and expeditiously. A paralegal's performance is measured, in part, by the movement of a file as well as the quality of their work. Thus, the entire procedure creates accountability and fosters in our staff, a sense of responsibility and pride.

    The firm understands that time is money and a slow-moving foreclosure is costly to our clients. Thus, we set internal time lines for the litigation with certain knowledge that our clients evaluate our performance for timeliness and accuracy.

    If the debtor files for bankruptcy, our Bankruptcy Practice Group moves quickly to assert the creditor's rights, including motions to dismiss or to lift the stay, where appropriate.

    Post sale matters are the provence of two more practice groups. The Evictions Group supervised by Dan M. Blumenthal, handle approximately 200 summary proceedings in the five boroughs of New York City as well as Nassau, Suffolk and Westchester Counties. Sales of bank-owned real estate are handled by the REO Group headed by Senior Attorney, Donna Casazza and staffed by two Associate Attorneys and four paralegals.

    The firm tracks its files through a custom data base tailored to our needs, its billing system is "PYRAMID and the spreadsheet software is Microsoft Excel 7.0. Other computer applications used by the firm are Mornet, Pencil Pushers, Abacus Law, Lotus, Corel Word Perfect 7.0, Lenstar, Windows 95, P.C. Anywhere, and Quattro Pro Ver 7.0.
