Condemnation / Eminent Domain Recent Decision: Matter of the City of New York [Chandler Street]

In a successful action to compel issuance of advance payments, court held bed of the street parcels are not valueless as a matter of law, condemnor has independent burden to prove just compensation, and condemnor must provide advance payment offers based on actual appraisals for the bed of the street parcels.
