Berkman Henoch Obtains Injunction Prohibiting County Comptroller Audit of Town

Berkman Henoch successfully prosecuted a writ of prohibition and obtained an injunction prohibiting County Comptroller, George Maragos, from auditing the operations of the Town of Hempstead Animal Shelter. Maragos, who had issued a broad-ranging subpoena to the Town, sought to investigate all aspects of the shelter’s operations and practices. On behalf of the Town, Berkman Henoch successfully argued that pursuant to the Nassau County Charter the Comptroller’s jurisdiction was limited to an examination of the Shelter’s balance sheet and budget.
