“The New York Law Journal published on April 27, 2023 an article by firm partner Bruce J. Bergman entitled “When The Mortgage Holder Might Have Pay The Receiver”. The piece is of particular application in commercial foreclosures where receivers are almost invariably appointed to collect the rents and preserve the property. The general  assumption is that the receiver’s fees and expenses are paid out of property income. When and why that may not be so-sometimes an unwelcome surprise to foreclosing lenders-is the subject of the discussion. Mr. Bergman, chair of the firm’s commercial foreclosure department is the author of the four-volume treatise Bergman On New York Mortgage Foreclosures, LexisNexis Matthew Bender (rev. 2023) and frequently serves as an expert witness in mortgage foreclosure, mortgage related, title and real estate actions.”
